Legal malpractice cases against a lawyer can involve an action or inaction that constitutes a deviation from the standard of care that causes serious adverse affects while representing a client. An example of legal malpractice is if a lawyer didn’t timely file a suit. For instance, in Louisiana you only have one (1) year from the date of an automobile accident to file your suit or you will lose your right to do so (in general). If a lawyer takes a case and assumes representation of a client and does not settle that case within a year and does not file suit within the one (1) year anniversary of the motor vehicle collision that lawyer committed malpractice and may be sued for the damages the client would have recovered from the initial motor vehicle collision claim.
